面對全球化城市快速成長、建築技術日益發展下，建築管理業務與日俱增、愈趨複雜，政府現有人力及人員專業已無法負荷。在現代國家行政潮流下，世界各國均開始引進民間專業力量協助推動政府建築管理行政任務；對此，如何運用及結合民間資源將其導入國家管制程序，是現今政府應面對之課題。建築法第34條於1984年修正時，創設「簽證制度」及「行政與技術分立原則」，其目的為加重建築師責任及明確劃分行政機關與簽證人之分工，以達提升行政效率之目的，建造執照經建築師及專業技師簽證後，行政規定項目經主管建築機關審查合格後，即可核發建造執照。惟近幾十年來，實務執行面上，多數地方主管建築機關在建造執照審查階段導入民間專業團體協助

辦理審查事務，但建築法對此作法並未見任何規定，由各地方主管建築機關各自為之。是以，本研究為釐清在政府維護公共利益及保障人民生命財產安全前提下，參酌美國及日本建築管理開放民間專業團體參與之運作內容及制度特性，反思我國現行主管建築機關導入民間專業團體協助建造執照審查之可行性、必要性及正當性，嘗試提出法制面及執行面之參考建議，期建構正當、合法、公正之民間專業團體協助建造執照審查機制，以保障人民權益。

污水下水道之建設為現行國家或都市進步之重要指標之一，在尚未建設專用污水下水道之地區，排水系統均以雨、污水混合共用之情形，讓鄰近建物周遭之溝渠藏污納垢，孳生蚊蠅細菌，多數先進國家皆已積極建設污水下水道，以改善及提升民眾的生活品質。 污水下水道用戶接管銜接管線位置均於建築線內之私有地，政府編列費用統一發包工程幫住戶代為施工，而施工前須取得土地所有權人同意始可施工之部分，為避施作中或施作後發生土地爭議（埋A住家管線，施作於B住家土地），相關用地取得均直接涉及民眾權益，另由於台灣地區污水下水道建設較晚，及都市大部分建築林立，後巷違建充斥，造成現行花蓮市污水下水道用戶接管未能順利進行，致

影響用戶接管普及率與整體效益。 本研究係以花蓮市污水下水道建設用戶接管為對象，探討用戶接管政策執行與政府處理的因果關係，從政策行銷面、鄰避情節面、紛爭處理面、違建查報程序面進行深度訪談分析，提出適用於花蓮市污水下水道用戶接管之政策行銷、紛爭處理、查報程序的參考建議，以利於政策執行之參考。
