這幾年新興菸品如電子煙、加熱菸的興起，對於世界各國的菸品管制均帶來了衝擊。目前我國將查獲的電子煙的分為以下幾種處理方式：倘若電子煙內含毒品有毒品危害防制條例管制；如含有尼古丁未依藥事法取得許可證則屬偽劣藥；即使電子煙不含尼古丁倘若宣稱具戒菸等醫療效能亦有藥事法規範藥物廣告。而近年來，最具爭議性的行政處分則為依菸害防制法第14條「任何人不得製造、輸入或販賣菸品形狀之糖果、點心、玩具或其他任何物品」及行政主管機關衛生福利部所為之行政函釋處罰未含尼古丁之電子煙品。本文爰以電子煙之相關科學實證、國內外相關管理規範、國內菸害防制法修正草案以及電子煙危害防制自治法案、行政法上預防原則和一般法律原則及幾個
